To receive a valid job offer from Canada, the employer must consider the following rules:

The employer must first present their job offer to Canadian workers, which includes citizens and permanent residents, before accepting a foreign applicant. In Canada, these individuals are given priority for hiring.

They must advertise the job for four consecutive weeks.

For high-paying jobs, the employer is required to post the job listing in three popular newspapers or job websites, while for lower-paying jobs, they need to advertise in five reputable job sources.

If, after four weeks of the job advertisement, no Canadian citizen or permanent resident has applied for the job offer, the employer must obtain an LMIA (Labour Market Impact Assessment) from Employment and Social Development Canada. This means they have to show that hiring the foreign worker will not negatively impact the Canadian job market or lead to local job losses.

The employer must submit the LMIA application no later than three months after starting the job advertisement.

The wage offered for the job cannot be lower than the standard wage for that position. Therefore, the employer must pay at least the average wage for that job in Canada.

Conditions for a Job Offer in Canada

The first condition for a job offer in Canada is that it must be valid. According to the Immigration, Refugees and Citizenship Canada (IRCC) regulations, if the job offer is not valid, a work visa cannot be obtained, nor will it receive points in the Express Entry system. The conditions for a valid job offer are as follows:

The job offer must be full-time, meaning at least 30 hours a week;

Important note: Our experience shows that recently, in many cases, officers are asking applicants for language certification. Therefore, it’s better to have a language certificate and present it.

But how can we prove that we have the required language proficiency level?

Since most work visas don’t require an interview with the job seeker (meaning the immigration office doesn’t interview the job seeker), the best way to demonstrate your language skills is by providing one of the recognized English or French language certificates. This could be an IELTS, TOEFL, or any other standard certification that’s internationally accepted.

As soon as the officer concludes that you have the language level needed to carry out the assigned job, that will be convincing enough for them.

You might ask what language score is accepted?

 The answer to this depends on the job you’re applying for:

For instance, if you have a job offer for engineering positions like civil engineer or architect, working in these roles requires attending meetings, participating in brainstorming sessions, communicating with clients, and understanding their needs, all of which demand a higher language proficiency. So having an IELTS score of 6 or 6.5 or higher could make sense.

On the other hand, if you’re going to Canada to work as a chef, naturally, you’ll need a lower language level. As a chef, you should be able to have simple meetings with the restaurant manager, understand their and the customers’ needs, and engage in basic conversations with other kitchen staff. This decision is temporary and the situation may change in the future.

To use your job offer for a higher score in the Express Entry system, it must meet specific conditions:

Example of a valid and invalid job offer

Example 1: Two companies are hiring an individual as a heavy equipment operator. The names of both companies are listed in the LMIA application. Each employer is offering this person 16 hours of work per week for one year. This job offer is valid.

Example 2: A construction company offers a plumber 25 hours of work per week, which is non-contractual. This job offer is not valid. For a job to be considered full-time, it must be at least 30 hours per week.

Points for job offers in Canada

In the Express Entry program, the points you can earn from a job offer depend on the NOC code of the proposed job. Depending on the skill level of the proposed job, you can earn either 200 or 50 points. Only jobs that are in high-level management can have 200 points:

200 points: Jobs that start with the NOC code 00.

50 points: All other jobs that have a skill level categorized in TEER 0, 1, 2, or 3.

Registering job offer information in the Express Entry system
